These terms are an agreement between you and the developer of Hearth: Home Inventory ("Hearth", "the app", "we", "us"). The app is published by an individual developer, not a company. By downloading or using the app, you agree to these terms. If you do not agree, do not use the app.
You can reach us at support@taomindapp.com.
We grant you a personal, non-exclusive, non-transferable, revocable licence to use Hearth on Apple devices that you own or control, subject to Apple's App Store Terms of Service and Apple's standard end-user licence agreement. You may not copy, modify, distribute, sell, lease, sublicense, or reverse engineer the app, or attempt to extract its source code, except where the law does not allow us to prohibit it.
Hearth is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the app will be uninterrupted, timely, secure, or error-free, or that any schedule, reminder, item record, or recall match it produces is accurate or complete. You use the app at your own risk.
Hearth is a record-keeping and reminder tool. It does not inspect, diagnose, or repair anything.
You own the content you put into Hearth: your item records, notes, photos, maintenance tasks, and repair logs. You grant us only the licence we need to operate the app for you — to store that content, transmit it, and display it back to you. We do not use your content for any other purpose, and that licence ends when you delete the content or your account. You are responsible for making sure you have the right to upload the photos and information you add.
You agree not to:
We may suspend or terminate your access if you violate these terms.
Hearth depends on services provided by others: Apple (Sign in with Apple, Apple Push Notification service, the App Store), Cloudflare (photo storage and the network tunnel to our API), and Tencent Cloud (our servers). Their availability and terms are outside our control.
Recall data comes from the US Consumer Product Safety Commission, a US government source, and is provided as-is. We do not control it and cannot guarantee that it is complete, current, or correct.
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, revenue, or goodwill, arising out of or relating to your use of, or inability to use, the app — including any missed maintenance, any incorrect or missing recall match, or any decision you made in reliance on the app.
To the maximum extent permitted by law, our total aggregate liability for all claims relating to the app will not exceed the amount you paid us for the app in the twelve months before the claim arose. As of the effective date above the app is free, so that amount is zero.
Nothing in these terms limits or excludes any liability that cannot lawfully be limited or excluded, and nothing here affects consumer rights you have under mandatory local law.
You may stop using Hearth at any time, and you may delete your account in the app (Settings, then Delete Account). We may suspend or terminate your access if you violate these terms, or if we discontinue the service. Sections 3, 4, 7, 8, 10, and 11 survive termination.
These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these terms or the app will be brought in the courts located in the State of California.
We may update these terms from time to time. When we do, we will change the effective date at the top of this page, and we will note material changes in the app. Continuing to use the app after a change means you accept the updated terms. If you do not accept them, stop using the app and delete your account.
